I have read the OFFICIAL CONTEST RULES for the BERLIN T-Shirt Design contest and I agree to all the rules and regulations of the contest as outlined below:

1. The contest is open to all residents of the United States who are at least 21 years of age as of June 1, 2019.

2. All entries must be original creations of the contestant that incorporates the BERLIN trademarks or logo) into the design, has never been published, and does not contain profanity, trademarks, logos, or copyrighted works of any other person, artist or business.

3. The top 10 winning entries will receive an invitation for two to attend Terri Nunn’s birthday party in Los Angeles, CA on Friday, July 12, 2019.

4. The winning designs will remain the property of BERLIN, and will not be returned to you. BERLIN may use the winning design at any time after the contest. The winning designers may display their own design in a portfolio or personal collection, but may not sell or reproduce the design for any other purpose once submitted to the contest.

5. BERLIN will choose the top submissions.

6. The contest begins at 8:00am PT on Friday, June 14, 2019.

7. The entries must be received via email by 5:00pm PT on Friday, June 21, 2019.

8. FORM OF ENTRIES:
   • The entry should be sent via email to berlinmerch@ymail.com accompanied by your legal name and contact information (including email address, residence address including city, state and zip code and cell phone number).
   • The entry may be any of the following art file formats via email: .JPG, .PDF or .PNG (Dimensions: 8" x 10")
   • One or more of the following key words should be incorporated in the design with the design intended for use on a black t-shirt: “BERLIN”, “40th Anniversary”, “40th Anniversary Tour”, “Transcendance”, “I Want You” or other words relating to BERLIN and its music.

9. If your entry is selected as the winning entry, the winning contestant who created the winning entry will receive an invitation for two to attend Terri Nunn’s birthday party in Los Angeles, CA on Friday, July 12, 2019.

10. The location of Terri’s birthday party shall be revealed to all winners on July 11, 2019.

11. BERLIN reserves the right to terminate this contest at any time, effective on the date of issuing the termination notice, and we are under no obligation to give notice prior to the date of termination.

12. You agree that if you submit an entry, you will sign an assignment and release form prepared by us acknowledging your acceptance and understanding of the complete contest rules including that the winning design is the property of BERLIN.

13. I shall be responsible for all taxes associated with the prize, including if the prize is forfeited after acceptance. Prizes are non-transferable. No substitution will be allowed and prizes may not be redeemed for cash or other consideration.

14. I shall be solely responsible for my own transportation to and from Los Angeles, CA, as well as to and from the location of Terri’s birthday party. I shall be responsible for any and all lodging, meals and other expenses incurred in connection with attending Terri’s birthday party in Los Angeles on July 12, 2019. For the avoidance of doubt, BERLIN will not provide winners with any transportation, meals or lodging of any kind.

15. All winners must bring a valid ID (driver’s license or passport) for entry into the venue for Terri’s birthday party.

16. Terri Nunn’s birthday party is NOT a public event and its location and other details must NOT be posted, emailed, texted, published or shared by or on behalfof any winner in any manner (including without limitation on social media). In the event a winner violates these Contest Rules (including this paragraph 16), such winner’s invitation will be revoked and said winner will be denied entry to Terri’s birthday party.

17. This contest is subject to all federal, state and local laws.

Acknowledgement and Assignment

I am submitting a contest entry with this form, and I hereby assign any and all rights in the intellectual property of this entry to Terri Nunn. I agree that the entry I submit becomes your property and that the entry will not be returned to me.

I state that this entry is my own original creation and that I did not copy anyone else's work in creating this contest entry. I agree that if I have copied anyone else’s work in preparing this entry, and if I win this contest, I will pay back the award to you and will defend, indemnify and hold harmless Terri Nunn and BERLIN and their respective officers, directors, employees, suppliers, licensors, contractors and agents against and from any loss, debt, liability, damage, obligation, claim, demand, judgment or settlement of any nature or kind, known or unknown, liquidated or unliquidated, including without limitation, all reasonable costs and expenses incurred including all reasonable litigation costs and attorneys’ fees arising out of or relating to claims, complaint, action, proceeding or suit of a third party, that arise or relate in whole or part to the contestant’s entry.

I agree that if I am selected as a winner in the contest, I authorize the use by you, without additional compensation, of my name and likeness or photograph for promotional purposes in any manner and in any medium (including without limitation the Internet, written or email communications, brochures, videos, slides, radio, television,film) that you deem appropriate. I agree that if I win this contest, the invitation for two to Terri’s birthday party on July 12, 2019 is fair and adequate compensation for my contest entry.
